1. Introduction

Welcome to FunHolidayCards.com ("we," "our," or "us"). By creating an account, purchasing credits, or using our AI generation services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

2. Description of Service

FunHolidayCards.com provides an Artificial Intelligence (AI) service that transforms user-uploaded photos into holiday-themed digital cards. You understand that AI generation is probabilistic and experimental. While we strive for high quality, we cannot guarantee that every generated image will perfectly resemble the subject or be free of artifacts.

3. Credits and Payments

• Credits: Our service operates on a credit basis. One generation consumes a specific amount of credits as defined in the interface.
• No Refunds on Used Credits: Due to the significant computational costs (GPU usage) incurred during generation, we cannot offer refunds for credits that have already been used, regardless of your satisfaction with the artistic result.
• Refunds on Unused Credits: Refunds for unused credit packages may be requested within 14 days of purchase by contacting support.
• Pricing: We reserve the right to change pricing for future credit packages at any time.

4. User Content and Conduct

You retain ownership of the photos you upload. By uploading photos, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process these photos solely for the purpose of generating your cards and improving the service for you.

You agree NOT to upload:

• Photos of people without their consent.
• Nudity, sexual content, or gore.
• Photos of public figures or celebrities.
• Content that infringes on copyright or trademarks.

We reserve the right to ban users who violate these safety guidelines without refund.

5. Ownership of Generations

Subject to your compliance with these terms, we assign to you all rights, title, and interest in the images generated by our AI for your account. You are free to use these images for personal or commercial purposes (e.g., printing cards, social media).

6. Limitation of Liability

To the maximum extent permitted by law, FunHolidayCards.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability for any claim arising out of or relating to these terms or our services shall not exceed the amount you paid us in the last three months.

7. Data Retention

We prioritize your privacy while ensuring your creations remain accessible.

• Source Photos: To protect your privacy, the original photos you upload are processed immediately and deleted from our servers shortly after the AI generation is complete. We do not store your personal source photos long-term.
• Generated Cards: The holiday cards produced by the service are retained in your private gallery to allow you to view and download them at your convenience. These images will remain stored until you delete your account or explicitly request their deletion.
